Elder Abuse

My mother, 88 years old, is giving all her money to my younger brother, who does not work. She is giving it away to the point that she doesn't have any left to pay her own bills. When my father died in 1987, she had thousands of dollars, all gone now. My question is, is it possible to have her declared incompentent and have my younger sister take care of her affairs, with my older brother and I monitoring all transactions?

Does Mom live in Nevada or Pennsylvania? If she lives in Nevada -

Take Mom to the doctor for a physical. If the doctor feels she is not capable of handling her own affairs, he can write a letter stating so and recommending a guardian. One of the family can petition for guardianship. I would be happy to help you take care of that in Las Vegas.

If Mom is being physically abused, call the State Welfare Office IMMEDIATELY. They have a elder abuse investigation unit that will be out to investigate the situation.
