Legal Question in Family Law in Nevada

after eleven years, my childs father has paid childsupport and for the last six years she has been covered under his company insurance. The insurance company is auditing their employers dependants. I have no legal documentation stating that he is her father. He wont pay for a paternity test. He states that he is going to garnish my child support payments until any and all claims that were made through his insurance company are paid back. I am a low income single mother. Can he do that? I am working on getting his name applied to her birth certificate in North Carolina, but he is only giving me five days from today to accomplish that. I dont know what to do and really need help on this.

Nevada has a form entitled "Affidavit of Paternity". If you both sign, this is an equivelant of a court order saying he is the dad. You can get it from the Vital Records on Shadow Lane or google it and I believe that there is form you can download. After it is notarized, it is effective so if you both are in Nevada, it should take only 10 minutes.
