Legal Question in Family Law in Nevada

My ex-husband passed away. My son was living with his father at the time, and is going to be 18 in November. He is going to inherit money through a life ins. and retirement account his father had. Is it necessary for me to apply for guardianship of my own child, or guardianship of the estate for him. He is going to be 18 soon, and this seems like a lot of expense and time when he is probably going to be 18 by the time all of this is done.

The life insurance company will probably require you to establsih a guardianship of an estate prior to paynig the proceeds. If it were me, I would want the money as soon as possible, but that is up to you if you want to wait until November. File a claim with the life insurance company and see what their response is.

Depending upon how much your son will receive will influence whether or not it is "worth it".
