Father seeking joint custody

My fiance never filed papers for rights to his son who is three. When him and his ex ended their relationship over a year ago, they made a verbal agreement about visitation and child support. Seven weeks ago his ex left with his son to Washington to visit family for a ''vacation''. We had an agreement to have his son for Christmas and she left anyways without even telling him. A week ago she finally admitted that she was now living there and, was not planning to move back here to Vegas. His name is on the birth certificate. We are wondering if what she did wasn't legal in any way, even though he doesn't have court documents establishing his rights. Is there a way that we can get him back here to Vegas? We would like Joint Custody and have him half of the year. Any advice would be greatly appreciated, Thank you.

You could file a Petition for Paternity and Custody. This should be done before your wife lives in Washington for 6 montns. Until paternity is legally established and a Court order is entered on custody and visitation, the mother will be presumed allowed to do as she pleases.
