Legal Question in Family Law in Nevada

Filed a petition for entire name change

Question why does it state in Michigan petition for name change. A box on hte petition.Clearly stating if parent has been convicted of child abuse. So,i checked it hoping i can change my daughters name.Since our perpertrator was given joint legal custody.(Before his sentencing)I was hoping to keep us safe in case he's relased.Yet, the judge(in Michigan) has asked me to show proof of service to him (for the name change). This goes against what were trying to acheive.I have put our names in the paper. But i can't serve him papers.i don't want to tip him off.Is there anyway around this? He's in prison in Nevada for child abuse.Isn't there any waiver i can present to this judge in Michigan?

Re: Filed a petition for entire name change

If he's in prison, then by the time he objects, the judge may have already granted the petition. And he can't even show up in person - which is good. Plus, even if he gets notice ahead of time and tries to object, that doesn't mean the judge won't stll grant it the petition - sounds like you have really good reasons for it.

You have to serve him with notice - so just do it.

Good luck.

Thanks.
