Legal Question in Family Law in Nevada

Fraudulant Marriage?

I was married in Las Vegas, NV in October of 2007. I just found out my husband lied on the application for a license and swore under oath that he was divorced in March of 2003. He was divorced in March of 2007. He deliberately lied. We lived together while he was a married man (no legal separation, I was not aware). Am I legally married at this point?

Re: Fraudulant Marriage?

yes because he was a single person when you were married. his divorce was final before you got married. not so sure that your argument for fraud under the facts sited would win you an annulment. if your marriage is over, then you probably need to file for divorce.

The Nevada Supreme Court says that if you can prove misrepresentation by clear and convincing evidence the Court may grant you an annulment. Until that happens you are married.
