future custody

During my separation with my husband, I got pregnant by him. The divorce was final during my fifth month of pregnancy. During the pregnancy, my ex husband didn't believe that the baby is his and he didn't want anything to do with him, but now that the baby is born he wants to be involved. My son is now five months. We have not gone to court to establish custody, visitation or child support and my ex husband has not yet even seen his son. Can he try to get custody of my son in the future even if he hasn't been actively involved and doesn't plan on being involved until he returns to the states in 2008 (he currently lives in England)?
