grandparent custody

My son and his girlfriend have been living with us for almost 2 yrs. They have a 8 month old son and no jobs or place to live. Can we get temporary custody?We are in the process of kicking her out and want the child to stay. She has no place to go. Her family will not take her in.

Yes. It can be tough because your rights are derived from your son and unless she is shown to be an unfit mother, you are in for a fight. I had a case just like this and we ended up with the son having primary custody while living with his parents and the girlfriend ended up moving to Texas to live with her sister.

Your grandson's mother sounds as though she is in worse shape. We can also do a guardianship to accomplish the job.

There are a couple different ways you can approach your situation. If your son lives with you primarily you can have him petition the court for primary custody of the child. This effectively puts you in the position of primary care giver through your son's custodial status as the father.

If your son is not living with you you have the ability to petition for a guardianship which puts you in the position as temporary custodial care giver of the child.
