Your rights are only available if your son or daughter is not exercising his or her rights. For example, if your child is deceased or has had his or her parental rights, you can petition the court for full visitation rights.

If your child is not divorced from their spouse, you virtually have no rights. If your child is divorced from the other parent, you can try to get visitation that is not being used by your child, ie. you might get one weekend a month by court order.

The theory is that a court should not tell parents who the child must see versus who the parents want them to see.
