Legal Question in Family Law in Nevada
my husband and i have ben married for almost 7 years now. we lived in alamogordo new mexico for 10 years together while he was in the air force. he retired 2 years ago and is a govmt contrator now. we are temporarly in las vegas for his job until aug then were being transfered to south dakota. how do i file for temporary custody of our two girls and emergency spouce support while in las vegas if were not residet? we dont plan on going back to new mexico

Your answer is dependent on how long you have been in Las Vegas. Since you are not returning from where you came from, the question will be whether you have jurisdiction over each component that is relevant -- divorce, custody, and support jurisdiction. Presuming, on your facts, that you have been here at least six weeks, and you are willing to declare NV your residence, at least for an indefinite period of time, you should, on your declared facts, be able to file here on each issue you mention. By the way -- the facts you relate indicate that there are other issues that are a little more subtle -- military retirement, accrual of property rights during premarital cohabitation, etc. You may be entitled to more than you think.
