Legal Question in Family Law in Nevada

My husband and I both went to jail and were there for a very short time. My kids stayed with my mother during this time. Also during this time, I guess my mother went to the courthouse and filed for temporary guardianship of my kids. She was granted the temporary guardianship because we weren't made aware of the court date.

Now, she refuses to let me or my husband see our kids. I was wondering if she had the right or authority to not let me see my kids because she is their legal temporary guardian

She has that right as the court approved guardian. You can have the guardianship terminated based upon 2 different grounds: (1) that you were not told about the court date, (2) that the reasons for the guardianship are no longer necessary because you are out of jail. If the guardianship is set aside because you were not told of the court date, expect your mother to seek a new guardianship and give you notice.

In any event, you should expect a contested hearing. Expect to be charged a minimum of $2,500 and if you hire a less expensive lawyer, you will get either a bad or a brand new lawyer. I have been doing family law for 24 1/2 years and if you want it done right, you need to pay.
