Legal Question in Family Law in Nevada
My husband and I have been seperated for three years.He and I never filed for custody of our three kids because we didnt want to go through court battles.Our kids live primary with him until I can get financially on my feet.I just found out from my kids that their dad has been smoking pot around them.My question is,can I get full custody of my kids even if my kids werent living with me?I can suppot them financially now and I have agood paying job.

While the reality of where the kids have been living for three year is relevant (see the Rivero case, on our Child Custody page), it is not by itself determinative -- that is left to the kids' "best interest." See: http://www.willicklawgroup.com/child_custody_visitation.
