Legal Question in Family Law in Nevada

Income Tax Interception

My son's father has not paid income taxes in about four years because he has not worked or made less than a certain amount to file. He was married as of March of this year and his new wife purchased A $500,000.00 home with him as an additional signer. I have started proceedings with the DA to place a lien on that property. My question is if he is listed as a dependendant on his current wife's taxes is my son entitled to anything?

Re: Income Tax Interception

The Nevada Supreme Court has stated that the new spouse's income is community property and therefore one half of that income can be counted in the mix when determining child support. In fact, the court may allow garnishment of a portion of his new spouses' income for payment of your ex-husband's child support obligation.
