Legal Question in Family Law in Nevada

Invalid Marriage?

Hello, I married a man in Las Vegas about 2 years ago. I was 16 at the time and i had run away from home (in NY). I obtained a false identification, that had a different spelling of my first name, by one letter. It said i was 18. And the I.D. was of a Mexican citizen (although it was fake). I did not include my Social or any other thing that could identify me. We were issued a marriage certificate. since i've left the state and now reside in another state. Now i have started to fix my life, including getting a divorce or possibly an annulment. But my lawyer asked me to verify whether my marriage was even valid. Please help?

Re: Invalid Marriage?

Our statute, NRS 122.05 allows a 16 year old to marry without court approval. I believe that you are married because your name was used, though the spelling was changed.

As to whether you need a divorce or annulment, there would be questions to be asked, such as did you live together, have sexual relations, introduce yourself as Mrs., etc.

I would charge $1,500 for an uncontested annulment or divorce and I would get it done as quickly as possible. Definitely less than two weeks after I was hired.

Re: Invalid Marriage?

Thank you for your inquiry.

In Nevada, you would be able to get married at the age of 16 without parental consent. If after your marriage you continued to live with each other, have intimate relations, and hold yourselves out to the public as husband and wife; etc. you would be considered married.

If your living situation was transparent and you never consummated the marriage you could file for an annulment as your marriage was never solemnized.

My office handles both these types of matters and handle both these matters. Contact my office if you'd like to schedule a free phone or in-person consultation to discuss your matter more fully.
