Joint Custody

My ex wife filed for divorce when i was in another state and unaware of it. She got full custody of my children. She has been in an abusive relationship and both her and her boyfriend have gone to jail for domestic violence. She has allowed me to see my children for the past year and has now stopped all communication. I want to file for joint physical custody. Can i file myself? Do i need an attorney? What are my chances of getting joint custody? Can a paralegal be of help?

When people ask me if they need an attorney, my response is always, "Can I walk into your job tomorrow and do it as good as you?" I have gone to law school and have been practicing for over 16 years.

If you have the funds, you should hire an attorney.

You have the right to file a Petition with the Clark County Family Court for a custodial hearing regarding your children. In pursuing such matters I always recommend that you consult and/or retain an attorney.

It is hard to give you an assessment of your chances without fully discussing your current situation, the facts surrounding the divorce, and your ex-wife's current situation.
