Keeping Ex-Wife's Property
My daughter just had her ''simple''divorce finalized. The decree states there are no property issues for the court to decide. They were going to amicably divide property. She asked for less than half of what they received as gifts and a few things she owned before they married. She did not ask for any part of the house he bought before they married or any of the furniture or other major purchases while married. Both had good jobs, neither gets any part of spousal income or business. Apparently she asked for more than he thought was friendly. It is actually less then they received and she added to the marriage. He agreed to some things and then he said he wants her to pay for half of certain divorce related expenses and income tax filing which he never demanded before. He also wants her to pay him for a brake job and engine work done to her truck that she brought into the marriage. He says that until she does, he is keeping most of the items she requested as 'Colatteral''. She is locked out of the house and could not get her possessions if she tried. Is this extortion, theft, swindling or anything that is illegal on his part? I realize she should have gotten the property before she signed papers. She thought he would be fair

She needs to hire an aggressive attorney to go after her property and she should seek attorney's fees for having to do so.

This is no crime. It is a divorce and the police have neither time nor interest. She needs to file a motion before the divorce judge to get any post-Decree relief.
