Legal Question in Family Law in Nevada
Hi, my kids were taken from me 3 years ago due to drug abuse,since then they have been with their paternal grandma. I have now been sober for a little over 2 years, and have been trying to regain custody. The problem is they live in California so I haven't been able to visit.Also, I have been out of work for 7 months so I have not refiled for termination of guardianship.I know I they won't award me custody when I am not financially stable at the moment. There dad just got out of prison and he seems to think that he is going to get custody. It worries me his mom has double standards for us because thats her son. What can I do to ensure that I get a fair fight? Do you think I have a chance , even though I live in a different state? Thank you for your time, this is very important and I dont want to spend another day without them.

Since you have been sober for 2 years, I have no doubt that you should get the children. I don't know what dad did to go to prison so I can't give you a complete answer. I think you have at least a fair fight. It does not matter that you live in a different state. The issue is whether paternal grandma just has a guardianship or has she terminated your parental rights. They probably wouldn't because for her to adopt, they would have to terminate the father's as well.
