Lawful parental rights
I have a son and his father was never put on the birth certificate, because we needed to get a paternity test, we never did, but they have the same last name. If he is not on the birth certificate does he have any parental rights?

I'm not certain exactly what you mean by "parental rights." All parents have child support obligations. Additionally, all parents have visitation rights.
It appears that paternity has never been established legally. However, the father could file a complaint in family court seeking court ordered-visitation and a determination of custody, paternity and support.
It does not extinguish parental rights merely because the father is not on the birth certificate.
