Legal Question in Family Law in Nevada

legal gaurdianship and adoption

My fiance' and I have been considering adoption and in the last few days a situation has come up with a family friend who just had a child and wants to put the child up for adoption. The issue is that the child was born in California and we live in Nevada. How can we obtain legal gaurdianship first and then begin the adoption process. The only issue is that the mother will be calling the adoption agency on Monday, and if that happens then of course the state will take the child and at that point it will really become very difficult to adopt the child. We really want to adopt but feel like if the child gets into the system that we will have no chance. Any advice will greatly be appreciated. Thanks

Re: legal gaurdianship and adoption

Right now, California has jurisdiction over the child because that is where the child lives. I am licensed in California as well as Nevada and I could petition a California Court for a temporary guardianship pending your adoption. Just because the mother calls an adoption agency does not mean they take the child, she would have to allow it. She can also allow you to have the child. You have just as much chance to adopt the child as anyone else and I think a greater chance if the mom wants you to adopt.

If you have any questions, you can write me back and I am willing to see you this weekend to get the ball rolling.
