Legal Question in Family Law in Nevada

legal to hold back visitation cause of child support

I think you misunderstude me. My wife wants to put it in our divorce that if I am behind on support then I am not alloowed to have my kids for our visitation times. She is in OK and I'm here in Vegas. So already I have not seen my kids since July 5th 2007. I don't think that me or my children should be punished because of this economy and how much I have been out of work for the last year.

She can only do that if you agree to it.

Thank you for your inquiry.

Such a clause between the parties is only enforceable if you both agree to it in writing.

If your wife is withholding visitation from you you have every right to petition the Court for enforcement of your order.

If your order was issued in Nevada you could bring a motion here.

Contact my office if you'd like to discuss your case in more detail.
