I have been married to My wife for seven years and have been living with her for 13 years. At this time we are in the process of getting a divorce in Las Vegas Nevada. Her ex husband is in the rears for child support for 2 children in the time I have been married I have provided for the children can I sue for a portion of her back child support since I was 50 percent provider. This is an issue I would have to do a little research on. The questions that come to my mind are: Can you sue under a theory of implied contract as you provided essential services to a minor? Does the answer to the last question change if you are a stepparent who may have certain duties inherent with that status? If you can, how far back can you go? If you haven't asked for payment, have you waived your right to it? How much would the support be--this would be based on the natural father's income during that time, the number of children, the custody arrangement, and other factors? Does the father even have money sufficient to go after him?
There is very likely law directly on point that will answer your question, however I advise you to consult with an attorney. Obviously, if the natural father is a dead beat, you may not be interested in chasing bad money with good by hiring legal counsel.
