I took money out of a joint account and put the money in my name with my husband as the beneficiary. I have been married for 22 years and have been a stay at home mom for 18 years. My husband says he is going to have me arrested for theft. can he do that since it was taken out of a joint account?

What you did you will not be arrested for but you will be accountable for if you go through court for separation or divorce.

Thank you for your inquiry.

Your taking money from a joint financial account is not sufficient for a criminal charge of theft. However, if you were to initiate divorce proceedings of any kind, all monies contained in the joint account would be split 50/50. Therefore, you would be accountable for any monies you took out of the account greater than your 50/50 share.
