Legal Question in Family Law in Nevada

move out of nevada

I have joint physical custody with my child's father for our 2 children. Dad does not take the children at all and I have them full time. I have been wanting to move out of state but held off on that since I know it is a difficult situation. As it turns out, dad moved out of state himself. Since he is gone, does that mean I can move with the minor children at free will or am I required to stay in Nevada even though dad is on the east coast?

Thank you for your inquiry.

In order to move out of state, if you have a filed Court order of custody and support; you need either the written permission of the other parent or an Order from the Court.

If you are able to obtain written permission from the other parent you can file a joint petition to the Court to Relocate. If you are unable to receive permission you can petition the Court yourself.

You are required to get written approval of Dad or an order of the Court. This is a no brainer and you can probably do this yourself. The self help center is on-line or you can go to the Courthouse.

Generally speaking, once there is a custody order a parent will be required to stay in this State and, if they wish to move, they need to gain permission from the court.
