Legal Question in Family Law in Nevada

My ex has moved and has not told me the change of address or phone #. It's been just about a year since she has moved. And in the divorce decree it states that she must provide me with any change of address or phone #. It also states that if one of us kidnaps, conceals or willfully detains the child it is a clas D felony. Now under Nevada law what are my legal options?

The first question I (or any other divorce lawyer) would ask is "what the heck took you a year to make an inquiry?" That said, if she left and you have remained here ever since, Nevada is still the place with presumptive jurisdiction to address the matter. For an explanation, see the article titled "The Basics of Family Law Jurisdiction," on the Published Works page of our firm web site, at http://www.willicklawgroup.com/published_works.

For a recap on the relocation cases, including what courts have done in a variety of circumstances, and the controlling statutes, etc., see http://www.willicklawgroup.com/child_custody_visitation.

By all means follow Mr. Willick's advice! If you don't know where your ex is, perhaps consider hiring a private investigator.

Your question raises a lot more questions. You said your ex moved, but you don't know whether it's out of the state or not? You also did not specify whether your ex has your child, but your question implies it. One wonders whether child support is being paid? Why you waited a year? I think you need a lawyer!

You should file a Motion in the Family Court for contempt. You send it to the address that the Court has for her whether it is her old address or not. The Judge will order her to appear and explain herself. The judge might also consider a change of custody but, like the others saying, it took you a year before you did anything.
