Legal Question in Family Law in Nevada

Moving out of NV to AZ

I would like to move from NV to AZ with my child. The father moved 2 yrs ago to CA, we have joint legal and physical custody in the NV court papers. He will not sign a form for her to leave NV. Child is 16 yrs old and wants to live with her father if I move to AZ. What is my best option?

Re: Moving out of NV to AZ

You first state that the father moved to California 2 years ago.

You then state that if you move to Arizona, your child wants to live with her father. Did the father move from California to Arizona?

If you want to move out of Nevada with your child, then you will need to file a Motion with the Court explaining that dad no longer lives in Nevada; so the court shouldn't have any problem with the move. Apparently, Dad is just being needlessly difficult by not agreeing to your leaving Nevada in writing.

You asked what your best option is? I'm not sure I understand what answer you are looking for. If you are okay with your child living with her father, then prepare an appropriate stipulation and order giving him custody, addressing child support, etc. If you are not okay with it, then get permission to move to Arizona and see what happens next.
