Legal Question in Family Law in Nevada
Non custodial parent moved out of state
I had a custody order done 8 years ago and my ex and I have made changes we have agreed on. I still live in Nevada where the order was done but he moved to NY and thinks he can demand when he wants to see our son. I asked him to have a new custody order done so that we have a schedule to follow he tells me he dosen't have to. In the original order all non insurance covered medical bills where to be split my son just had $5000 in braces and he told me he dosen't have to pay and that I am angry that he is refusing to pay that is why I want a new custody order. The summer is coming do I have to send my son to NY or can I go by the original order untill he has it redone? I did send my son for spring break as he is allowed three weeks of vaction out of state per the original order. I have not inforced the child support part of the order it has never been about the money to me.

Re: Non custodial parent moved out of state
You can follow the original order and deny him the summer visitation. I am not sure that I would recommend it as it is not in your son's best interests not to see his dad. What I would do is send him the $5000 bill for the braces certified return receipt requested and a demand that he agree to pay half. Did you already pay the whole amount or are you on payments? If on payments, he should make half the monthly payment. As to the revision of the order, I would do that when you go to court because I believe that you would have to go back to court when he doesn't make the orthidonture payment.
