My non-biological son(3yrs old), who I have guardianship of, (given to me by the state-cps), has recently gone through the process to determine who his father is, even though we have known who it was, it wasn't ever official until now. He(the so-called father) had never acknowledged my son EVER, has only visited him two times since birth and that was before the age of 6 months. My son has my last name on his birth certificate. I am wondering what righs I have, or what I can expect to happen through the court system. The biological dad is just doing it out of spite, and doesn't have the time, energy or love for him, I want to know if there are any steps I can take to make sure that my son stays with me? My son's biological mom stands by me 100%. This is also being done because the state is involved and are looking for back child support payments because he was ordered previously to get a paternity test, but never showed up, until about a month ago when he was ordered for the second time.

The natural father would have to go through guardianship court to get custody. You can fight him there. If it is in the best interest of the child to remain with you he will. However, if the father is halfway decent he will be entitled to visitation.
