if on parent has legal and physical custody of there children can the other parent change custody agreement?

Maybe. It depends primarily on one thing: will it be in the best interest of the children to modify or change the existing custody arrangement? In short, if you can convince the court that it will be in the best interest of the children for the existing custody arrangement to be changed, then it might be changed accordingly.
