Legal Question in Family Law in Nevada
If my parental rights have been terminated am i responsible to pay child support andcan they legally take child support out of my wages
1 Answer from Attorneys
Well, no. At least not in Nevada, and not as to future support.
In some states. parental rights and responsibilities are considered separate, so terminating one does not terminate the other. In Nevada, they have always been assumed to go together, but there is no case discussing the holdings to the contrary elsewhere.
If there were support arrears outstanding, they remained owed unless dealt with (by waiver or otherwise) in the proceedings leading tot he termination. But there should be no prospective support owed. If you think the D.A. is garnishing wrongfully, make an appointment with your prior caseworker and go down to the D.A.'s office with a copy of the order.
