Legal Question in Family Law in Nevada

I need to get a passport for my stepson. My wife has sole custody, but we have not seen the biological father for 10 years and he wont even respond to a registered letter. We tried to get a passport but were told we need a court order. How do we obtain the court order and what would we need to file in court?

If you have an order giving you sole custody, then I am surprised that the US State Dept. didn't issue the passport.

You would need to file a Motion to be declared the sole legal and physical custodian and include a request that the US State Dept. issue a passport without the parent's permission. The Federal government does not have to honor a state court order, but they most likely will.
