Legal Question in Family Law in Nevada

reduction of child support

My husband has been paying child support for the last 13 years. We now have a child of our own. Can support for child one be reduced? What if mom has moved out of state? Does this require approval from someone? Can the cost to travel and pick up child every two weeks be considered in reduction proposal?

According to the decree, the mother is to have health insurance and father covers co-paymnents. What if mother is not carrying full coverage (vision/dental)....and she does not take the child to the doctor?

Lastly, in our stae we have the MILLENIUM Scholarship for high school graduates who have attended since 10th grade. Mom has statred she WILL NOT pay for college. ''ASK your dad'' is her response to child. What's the chances of having custody placed to father so she can be eligible for the scholarship?

Re: reduction of child support

The court may take into account a child from your present relationship and reduce child support. If mom moved out of state NRS 125C.200 requires that the custodial parent get permission from the non custodial parent or the court before moving The court can consider a move without such approval as a basis for changing custody. The cost of travel may be considered by the court in allowing a reduction in child support. In Nevada custody will be changed only if there is a substantial change of circumstances and it is in the child's best interests. Changing custody because it would make the child eligible for the millennium scholarship funds is not a substantial change of circumstances warranting a change of custody. Insurance should be maintained on the child. Usually, the court looks for the person with the least expensive coverage through their employment and then splits the costs. It depends on the exact language of the Decree in your instance.
