Legal Question in Family Law in Nevada
Relinquishing an unfit fathers rights
My Wife has 2 children from a previous unmarried relationship. The father has been documented as being abusive to her and the kids. She has a restraining order on him and his visitation has to be supervised. In addition, He hasn't paid child support in several months, nor made any attempt to see the kids. Here is where it gets a bit ''Jerry Springer''... The Fathers Step-mother (whom never officially adopted him ''the father'') has threatened my wife that she would fight for custody of my wifes children if she doesn't get to spend every other Christmas with them at her home on the opposite coast! First of all As she isn't The fathers biological mother she doesn't have any rights to my wifes children does she? Then, as a new member to these shark infested waters what is my best course of action for making sure the father can't interfere in our new life together? Apprently Levinia is involved but are absolutely useless thus far... Please help!

Re: Relinquishing an unfit fathers rights
An option would be for your wife to attempt a termination of parental rights proceeding. However, that is difficult. As far as being unmarried to the father of her first children that is really irrelevant in Nevada. The father's stepmother may have a case of grandparent's visitation rights despite the lack of blood relations. It depends on whether the judge thinks it would be in the best interests of the children to have such visitation and under what circumstances.
