selling of joint property

i have left my boyfriend of 5 years. we own a home together, and we have 2 toddlers that we share custody of. i want to force him to sell the house, so i can get on with my life. he refuses, do i have any legal standing? i am afraid he will ruin my credit and ruin the condition of the house. can i force a sale?

If he is domestically violent you can apply for a restraining order which if granted will remove him from the house. Alternately you need to take him to court on a paternity action so that you can get child support and divide the real property by way of a partition action. You should consult an attorney.

I would assume that you and he are joint tenants or tenants in common on the deed. Your remedy is to bring an action for partition. This will force him to bargain with you or we will request that the court order the house to be sold.

You can file a petition for sale in District Court or a petition for custody in Family Court or both.
