sons father took son for visit and won't give him back

Who is the custodial parent when there is no court order and the parents aren't married?

Thank you for inquiry.

If you are two unmarried parents and have no Court order defining the custodial and visitaiton arrangement of your children then you both have joint custodial rights.

If you are unable to come to some sort of agreement amongst yourselves out of court I would STRONGLY encourage you to hire an attorney.
