Former spouse abuses children
My former spouse was convicted of felony child abuse, and the children were allowed to remain in the home. The case plan was completed. The abuse has continued. Her significant other, and his family have also abused the children. I am uncertain if they were charged. I reported and incident of abuse that occurred during the case plan to CPS, and the children confirmed to the in-home worker the abuse. The abusers told a separete version and were allowed to continue the case plan. The case plan was closed in April, with custody remaining with my former spouse. I recently was told by my oldest child (6) that she is being locked in a dark closet as punishment, and that she is being forced to do push-ups and leg lifts as well. My youngest child (3) has told me that she is spanked with a wooden paddle by at least 6 other adults in that family unit, to include my former spouse and her boyfriend. We were divorced in CA, I gave her permission to move to NV with the children prior to the abuse. I would like some assistance in removing my children from this situation, without risking future custody.

You need to get the children out of NV for an extended period. CPS did not consider you for placement? Call me directly at (619) 222-3504.

The judge that handled the abuse case and the judge that would determine a change of custody will not be the same judge. I would suggest filing a motion for change of custody and fight to get your children back. The juvenile judge can only return your children to your former wife if she completed her case plan, but this is not at all binding on the family court judge.
