can i sue my ex wife??

I was wondering if I could sue my ex-wife for such things as causing emotional and financial distress. We have been divorced for a little over six years and she has taken me to court over 40 times costing me not only time lost from work for the hearings, but the emotional stress of dealing with her false claims as well as all the legal fees (over $40k) associated with it? Any ideas???

Yes, there is a lawsuit called abuse of process. However, if the family court did not award you attorney's fees, you may have waived the right to ask for attorney's fees and you would be limited to emotional distress and lost work.

Thank you for your inquiry. The only civil claim that you could bring would be under an abuse of legal process claim. In order to prove this claim you need to be able to show that your wife's legal filings have a pattern of frivolity and dismissal by the residing Court.

If you are able to show this you would be able to ask for compensation for time lost at work, emotional distress, and potentially attorneys' fees should if you had originally pled for them in the Family Court.
