Legal Question in Family Law in Nevada

Need the toughest lawyer out there for relocation of custodial mother

Hello, i have a case going through 8th district family court right now regarding my ex-wife's relocations to San Diego. this is actually the 2nd motion on this item. The first motion was filed with out attempting to seek my permission(both her and her attorney admitted this too). Her claim in that motion was that she was fighting some illness and needed her mother's support in San Diego to get through it. during the year and 3 months this was in the system her story changed so that it was our 6 year old son who was allergic to the heat and sun of las vegas. The first motion was dismissed due to any proof that she was sick. During the hearings though the judge allowed her to move to san Diego ''temporarily'' because the ex stated that she had already sold her house and would have no where to live(this was also a lie). A second motion was filed early this year claiming new reasons to move, but still based on her needing a support system in SD because of her illness and her desire to go back to work. at the last hearing i agreed to let her move if she needed this support system. She now wont sign the order based on the agreement claiming she doesnt need to a get a job and is so sick she is not allowed to even look for one.

Thank you for your inquiry.

In order to more fully advise you of your situation I would need to know the current custodial arrangement between you and your ex-wife. You may have grounds to petition the Court for primary physical custody to allow your children to reside with you in Nevada.

If you would like to schedule a consultation to more fully evaluate your situation feel free to contact my office. We always offer free initial consults.

Regards,

Jim Herbe
