Legal Question in Family Law in Nevada
visitation
I have a TPO against my husband and he filed to dissolve and aquire visitation EX-Parte. If visitation is granted but my children do not want to go with him do they have the right to say they don't want to go?

Re: visitation
Probably not. If your child needed a shot but did not want it because it would hurt, would you allow that. Judges do not allow children to make adult decisions; however, if domestic violence is involved, convince the judge that the children are in danger and there would be supervised visitation or none.
Re: visitation
children do not really get a say in their custody division until they are teens. At 16 they have a say; at 6 they don't. The Courts think that alienation of affections by one parent may cause that parent to suggest and control the children on the custody issue.
