Legal Question in Family Law in Nevada

visitations & child support

wife and i seperated. she lives in nevada due to economical reasons i moved out of state. i phone my son everyday and i am not current employed but do send $25.oo a week. i currently have my son for his spring break and paid for his flight. we are trying to go through an uncontested divorce as wife wants to remarry. on the visitation portion of the form she has me with visitations for one week during spring break. thats it. i want to revise but dont know how to be specific when i want visitations when he is not in school and to total only 6 weeks a yr. which i belive is fair. and i would be paying flight expenses. my issue on that would just be wording. since school ending dates change. and she may be moving out of state as her soon to be husband is joining the service. so i believe her stipulation in the papers stating if i move to the state my son resides then i can have him every other weekend. not fair if i have to follow them around as they move. it does say on there also that neither of us has an income currently. but as soon as employment is obtained i am to pay $400 a month on or before the 18th. wondering if that is fair considering i may not make much and would not be able to afford myself. i have no problems paying

Re: visitations & child support

Your question raises a lot of issues. You really need to talk with competent legal counsel in Nevada (to adress the issues of custody and visitation) and possibly Illinois to address the issue of child support.

I would strongly suggest that you find some money to consult with a Nevada lawyer prior to signing any Nevada legal documents. The are other holidays to think about besides Spring Break (Christmas, Thanksgiving--is the child attending a year round school with track breaks, etc.)

Will you get an offset for your child support for travel costs? Who will provide insurance, etc. Is the child allowed to relocate overseas??

It would be difficult to know exactly what would be a fair fee for the work without knowing a little more about your situation. Our firm, for example, does flat fee arrangements often for matters such as yours. Feel free to give me a call if you have any questions.
