Hit by a DUI-Drug offender

I was on my moped stopped at a red light behind another car, when I was struck from behind by a Ford F-150 traveling 45 mph. I was thrown from my moped and my moped was totaled and clothes were destroyed. The driver then hit the car in front of me. I went to the hospital via ambulance, where it was found that I had no serious injuries, although my leg and knee are in pain today. I will follow up with my regular physician. The driver of the truck was arrested for DUI-Drugs. What are my options?

You should get treatment for your leg and knee. Hopefully, the driver who hit you has liability insurance. Do you have uninsured/underinsured motorist coverage on your moped? If you don't your only source of recovery will be if the drunk driver has insurance. If the drunk driver doesn't have insurance attorneys will not want to represent you on a contingency fee basis and you will not want to pay them. You can find out if the drunk driver has insurance by getting a copy of the police report, although it takes a good several days at a minumun for the police report to be ready. I would be happy to represent you, but in all honesty, I would cease to represent you if there is no insurance. If there is no insurance you could file a claim with DMV by yourself and the drunk would probably have to come to terms with you to get his license back.

You should get a copy of the police report. Unless it happened in North Las Vegas or Henderson, then LVMPD should be able to provide you a copy in a few days.

You should make sure that you follow up with your regular doctor.

Once you find out if the person who hit you has insurance, you or a lawyer hired by you, can make a claim against that person's policy.

You should look for the receipts for your clothes and other property that was damaged.

If you have insurance on your moped, you should notify your insurance company that you were involved in an accident.
