Legal Question in Civil Litigation in Nevada
I owed my ex-husband some money from right after we got divorced and I didn't pay him as quickly as he wanted to so he took me to court and got my wages garnished. I am supposed to pay him a total of $2697 which included intrest and his attorneys fees. as of my paycheck on 12/31/10 I had paid him was $2608.37 which means i am only supposed to pay him 88.63 out of my paycheck on 1/14/11 however they are taking 235.76 out of my check. I sent an e-mail to the payroll department at my company and they wrote me back stating that we will need an order that states the garnishment has been satisfied in order to stop it. I have spoken to my attorney and he stated that the plantif's attorney needs to handle this. So I called the plantif's attorney and he told me that my attorney needs to handle it. I am not sure what to do at this point. My payroll department states that there is also intrest in the original paperwork but the notice of garnishment states that I only need to pay the $2697.

You have an attorney. If it is a matter of fees, you'll have to hear that from him, and it may be necessary for you to pay for further services. Without knowing what specific tasks you retained him to perform, it is hard to say if he is responsible for taking care of this loose end, but it should not be a difficult or particularly time-consuming thing for his office to do for you. Tell him the job is not done until the garnishment is cleared and if you truly have fulfilled all your obligations, this one is on him to wrap up. If, indeed, this was part of the work he was to perform, hold him accountable for representing you, or tell him you will report him to the State Bar Association.
