Legal Question in Civil Litigation in Nevada
I'm a private person and sold my personal atv to aother person who after 5 days tells me he rode it for a few miles and it broke. He is demanding I take it back and refund him or pay him $1100 for parts. They already took it apart to see whats wrong. I said no and he threatend to take me to court.
Prior to buying it he and his friend who owns another artic cat and does his own repairs asked if I rolled it and I said once. He asked if it had ever been tuned and I said no. They looked and listened to it closely and both drove it down the street. He even said there appears to be no loss of power though.
They purchased it for $3300 which is $400 less than I was asking and if sold by a dealer would be $4100. The title was signed and I gave him a bill of sale only stating the item and amount of the sale. WHen they loaded it in his truck the ramp slipped and the atv slammed down on the tailgate bending the tailgate and then it hit the ground.

You cannot stop them from bringing you to court, but you'd likely prevail. It'd probably be well worth your while to consult with an attorney immediately after you have been served with a summons and complaint.
