can i sue someone i loaned money to and he refuses to repay me? we didn't sign a promissory note but i sent it to him in a money gram form and i have a copy of the receipt.

Yes, you can sue someone to enforce an oral contract in many, if not most, circumstances, but almost always when the circumstance involves a loan. You will need to prove that an oral promise to repay the loan was made from whom you tendered the payment (the person who received the money could claim that it was a gift, in which case, he would have no obligation to repay you). The evidence of the money gram, along with your testimony, and his, might be enough to prove your case. To begin the process, you will first have to select the forum (or court) in which to bring the lawsuit (i.e., small claims court, justice court, district court, etc.). It may be worth your while to consult with an attorney who will be able to point you in the right direction.
