Legal Question in Immigration Law in Nevada

Applying for citizenship

I am a green card holder and will be applying for the citizenship this year, my spouse came to the US as a student but never went to college. Since the visa is expired will it be an issue for me to apply for the citizenship? Do I have to have job to Apply for the Citizenship ?since they ask the spouse's info in the application will they come after my spouse regarding the illigal status? I have a kid. After i get my citizenship i will be going back to work, full time, can i sponsor my spouse after i get my citizenship?

Re: Applying for citizenship

Your spouse's immigration status does not affect your citizenship application. You do not need to have a job for the citizenship either.

USCIS can go after your spouse who is here illegally, but practically they rarely do it. You can sponsor your spouse once you become a USC.

Re: Applying for citizenship

If you successfully become a United Sates citizen, the fact that your spouse overstayed his visa will not be an issue. Please make certain that spouse does not travel outside of the USA prior to receiving his/her green card as he will face a three/ten year bar. You are not required to have a job to apply for United States citizenship.
