Legal Question in Immigration Law in Nevada

I am a Canadian who got married to an American

I am a Canadian citizen who just got married to an American citizen. Once my spouse file the petition papers, how soon can I start to work here? Can I travel in and out of America while my papers are being processed? Thank you.

Congratulations on your recent marriage!

As the spouse of a USC you qualify as an immediate relative and can file for Adjustment of Status (to a green card) immediately if you have current status. At that time you may also apply for advanced parole and work authorization. Advanced parole will allow you to travel while your application is pending and work authorization will allow you to work during the same time frame.

Procesing times vary between local offices. Please feel free to call me directly if I may be of further assistance at 619.233.0900.

Sincerely,

"Immediate relatives" of U.S. citizens enjoy a "one-step" filing procedure for obtaining Lawful Permanent Resident status which is not available to other categories of family sponsored immigrants. For more information, Please visit my website at www.usa-immigrationattorney.com.

A one-step petition can be filed for this type of case since you are considered an immediate relative not subject to the quota system.
