Legal Question in Immigration Law in Nevada

Child here illegally

I entered the states in 1998 on an F1 student visa with my then, 6 year old daughter, and later on obtained my green card, thus making me a legal permannet resident alien. When I received my green card I presumed at the time that my daughter was on my green card as she was on my passport. Now, she is 16 and when I applied for a social security number for her they want her green card - she does not have one. After further investigation I now find that she is not even here legally. I am absolutely devasted as I am worried that she will be deported. I know the right thing is to immediately start a petition to get her here legally, but my question is can they deport her prior to my completing this??

If you are eligible to become a U.S.Citizen, you should do so immediately. Also, you should file a petition for daughter (Form I-130) as soon as possible. Your daughter may not be deportable if you obtain a family hardship waiver from the Immigration Service.
