Legal Question in Immigration Law in Nevada

eligibility for employer sponsorship

I entered the US with a B-2 visa and i have been here for a year already. My I-94 is no longer valid. I found an employer who could sponsor me. Can I still be sponsored even if my I-94 is no longer valid? What are my other options?

thanks

Re: eligibility for employer sponsorship

You are not eligible for h1 but you can go for labor certification and after that is approved..and I-140 is approved if 245 (i) is active you can pay the fine and get yourself adjusted here...if 245 (i) does not come back you have to go back to your country..go through consular processing ...and you must qualify for waiver...by showing extreme hardship to a US parmanent resident or citizen (if you have imediate family members in that category). Other alternative would be to marry a US citizen...if you are not married.
