green card renewal

I received my green card which is good for 2 years, can I apply on my own upon renewal for the 10 year green card. I am divorcing my spouse because of abuse.

If you have a conditional "greencard" and are now petitioning to remove the conditions, the general rule is that both parties are needed to establish a continued bona fide marriage.

However, when there is abuse in a relationship, there is an exception to the general rule. It is possible to file a waiver and self-petition.

I would need some more information before advising you. I will assume that you have a conditional green card based on marriage. As such, you are required to lift your conditional residence and to do so you will typically need the cooperation of your spouse. However, if you are looking to petition for benefits on your own, given the incident(s) of abuse, the process becomes much more complicated.
