Legal Question in Immigration Law in Nevada

Hi,

I just wanna ask I filed a re entry application first week of oct. and received the notice oct,6,2010. This was in expedite process to make the biometrics fast enough for me to have the scheduled notice, but up to now Nov.18,2010 I have not received a mail from the USCIS stating my biometrics sked or what. Can I cancel my re entry application form and go back to my native land and fly back to the states less than a year where i could refile a re entry permit in a future date for me to really wait for the processing time frame. Would that be possible? If yes, how would I inform the USCIS about this concern of mine that would not affect my green card status and future naturalization.

Note: I have to go back to the Philippines this Dec. for me to catch up with my unfinished studies for better job placement I would get based on my academic background when I would enroll for such this year. Since it's recession in the U.S & as my 3rd year here I did not land myself in a job that employers would easily employ me in.

Yes just write to the same service center you submitted the re-entry application to and state you wish to withdraw your re-entry application.

But I must advise you that if you are staying outside the U.S. for more than 180 days but less than one year - make sure you maintain home ties to the U.S. (such as lease.employment.
