It would depend on how did he last enter the USA (visa, without inspection, etc), what exactly are the charges and what was the court disposition. If he came illegally to the USA, quite possibly he will not be able to complete the adjustment of status process while staying here in the USA. If he did come legally the last time he entered, you could petition for him once you marry him, but you should consult with an attorney regarding his criminal charges.
